These Terms of Use ("Terms") are an agreement between you and EarthWise Permaculture ("EarthWise," "we," "us," or "our"), a business registered in Ontario, Canada, governing your use of the EarthWise Permaculture Design web application (the "App"). By creating an account or otherwise using the App, you agree to these Terms. If you don't agree, please don't use the App. See also our Privacy Policy, which explains how we handle your personal information and is part of this agreement.
The App is a design and planning tool for permaculture and food-growing sites. It helps you sketch zones, sectors, water systems, plantings, and structures, and gives you estimates and reference figures (like water budgets, food self-sufficiency estimates, and climate data) based on the information you enter and public data sources.
The App is a planning aid, not professional advice. It doesn't replace the judgment of a qualified engineer, surveyor, agronomist, electrician, or other licensed professional. Anything you design or plan in the App — earthworks, water systems, structures, plantings, livestock, or anything else — is something you choose to implement at your own risk. Before you dig, build, install water infrastructure, or make other real-world changes to your land, check local regulations, utility locates, and permit requirements, and consult a qualified professional where appropriate.
You need an account to use the App. You're responsible for maintaining the security of your account and for all activity that happens under it. Let us know right away if you believe your account has been compromised.
You must be at least 13 years old to use the App. If you're using the App on behalf of a business or other organization, you're confirming you have the authority to agree to these Terms on its behalf.
Using the App requires a one-time purchase for base access. An optional Pro subscription unlocks additional features and renews automatically (for example, monthly or annually, as shown at checkout) until you cancel it.
All payments are processed by our payment processor, Lemon Squeezy, and are subject to Lemon Squeezy's own terms as well as these Terms. We don't receive or store your card details. Prices, available plans, and what each tier includes may change over time; if we change what's included in an active subscription in a way that matters, we'll make a reasonable effort to let you know.
You can cancel your Pro subscription at any time from Settings → Manage Subscription, which opens Lemon Squeezy's self-serve billing portal — cancellation takes effect at the end of the current billing period unless stated otherwise at checkout. Charges are generally non-refundable except where required by law or at our discretion; contact us (see "Contact us" below) if you have a billing issue and we'll take a look.
When using the App, you agree not to:
We may offer early-access or beta features from time to time. These may be incomplete, unstable, or changed or removed without notice.
You own the designs, site data, and other content you create in the App ("Your Content"). By using the App, you give us a limited license to host, store, process, and display Your Content solely as needed to operate and provide the App to you (for example, saving your designs, rendering them back to you, and generating exports you request). We don't use Your Content to train third-party AI models, and we don't sell it.
You're responsible for Your Content and for making sure you have the right to use any site images, measurements, or other material you upload.
The App itself — its software, design, text, graphics, and the EarthWise Permaculture name and logo — is owned by EarthWise Permaculture or our licensors and is protected by copyright and other laws. These Terms don't grant you any rights to our branding or software beyond what's needed to use the App for its intended purpose.
The App relies on third-party services to work: Google Firebase (accounts and data storage), Vercel (web hosting), Lemon Squeezy (payments), NASA's public POWER API (rainfall, sunlight, and wind data), and public terrain map tiles (elevation). Your use of the App may also be subject to those providers' own terms. We aren't responsible for outages, changes, or errors originating from third-party services outside our control.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the App will be uninterrupted, error-free, or that any estimate, calculation, or climate data it provides will be accurate or complete for your specific site.
To the fullest extent permitted by law, EarthWise Permaculture won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the App — including any real-world outcome of implementing a design or plan you created in it. Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months before the claim arose.
Some jurisdictions don't allow certain limitations on liability, so some of the above may not apply to you.
You can delete your account at any time from Settings → Delete Account, which permanently removes your account and design data and cancels any active Pro subscription in the same step.
We may suspend or terminate your access to the App if you violate these Terms, if required by law, or if we discontinue the App — in which case we'll make a reasonable effort to notify active users in advance.
We may update these Terms as the App evolves. We'll update the "Last updated" date above when we do, and for material changes we'll make a reasonable effort to let you know within the App. Continuing to use the App after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
